Chief Ministers Constitutional Power
The functions, responsibilities, and obligations of the Chief Minister as outlined in our constitution are explained here
- Article 163 – The Chief Mister, who serves as the head of the council of ministers, advises the governor.
- The Chief Minister is chosen by the governor by Article 164 of the Constitution.
- The Chief Minister serves as a liaison between the Governor and the state council of ministers by Article 167 of the Constitution.
Chief Minister Appointment
- Article 164 solely states that the governor shall appoint the Chief Minister.
- The Governor, however, is not free to choose a candidate to serve as Chief Minister.
- According to parliamentary system conventions, the chief minister must be appointed by the governor and come from the majority party in the state legislature.
Chief Minister Qualification
- They must be Indian nationals.
- They must be older than 25 years of age.
- They have to be a legislator in their state (MLA). If the individual is not already an MLA when they are appointed as the Chief Minister of a State, they must become so within six months of their appointment by running in an election in their appropriate seat.
Role of a Chief Minister
According to the Indian Constitution, while the governor acts as the ceremonial head of state, the real executive authority is vested in the Chief Minister. After state legislative assembly elections, the governor typically invites the party or coalition with a majority to form the government. The Chief Minister, appointed by the governor, leads the council of ministers who are collectively accountable to the legislative assembly. Chief Ministers are generally appointed for a term of up to five years, with no restrictions on the number of terms they can serve. Most Chief Ministers also serve as the leader of the house in their respective assemblies, except for Tamil Nadu’s M. K. Stalin.
CM Tenure
The Chief Minister’s term is not set in stone, and he serves at the governor’s pleasure. There are a few conditions, such as:
- The Governor’s inability to remove him at any time.
- Even once he has the approval of the majority of the house, the governor cannot remove him.
- The Governor will dismiss the CM when he loses the majority’s backing.
Facts about Chief Ministers of India for UPSC
- Since March 5, 2000, Naveen Patnaik has been India’s chief minister for the longest period of time (for 22 years, 141 days).
- Zoramthanga of Mizoram is the oldest Chief Minister currently serving in India; he was born on July 13, 1944.
- Of the current chief ministers of India, Nitish Kumar has held office for the longest period of time (7 Terms) as the chief minister of Bihar.
- Prema Khandu, the chief minister of Arunachal Pradesh, was born on August 21, 1979, making him the youngest chief minister in India at the moment.
