Cabinet

The Cabinet is a small group of 15 to 20 ministers and is the main part of the Council of ministers. It holds real power in the government. The 44th Constitutional Amendment Act of 1978 added the term “Cabinet” to Article 352 of the Constitution, even though it wasn’t in the original Constitution. Article 352 defines the Cabinet as the Prime Minister and other ministers but doesn’t explain its powers.

The Cabinet’s role in our government follows British traditions. Here are its main functions:

  • It is the highest decision-making body.
  • It makes key policies for the Central Government.
  • It serves as the main executive authority.
  • It coordinates the central administration.
  • It advises the President, and its advice is mandatory.
  • It manages crises and emergencies.
  • It deals with major legislative and financial matters.
  • It oversees top-level appointments, including constitutional authorities.
  • It handles foreign policies and international affairs.

Cabinet Committees:

Under Article 77 of the Constitution, the President can create rules for the Union Government’s work and assign tasks to ministers. This includes two main sets of rules:

Allocation of Business Rules: These rules determine how subjects are divided among ministries and departments.
Transaction of Business Rules: These rules guide how ministries operate, including consultations and cabinet committees.
According to the Transaction of Business Rules, the Prime Minister can create or disband Standing Committees of the Cabinet and define their roles.

  • Cabinet committees are not mentioned in the Constitution; they are extra-constitutional.
  • The Prime Minister forms these committees with selected cabinet members for specific tasks.
  • The Prime Minister can change the number of committees and their functions.
  • If the Prime Minister is part of a committee, they lead it.
  • Membership usually ranges from three to eight members, primarily consisting of cabinet ministers, though non-cabinet ministers may also participate.
  • These committees tackle issues, develop proposals for the cabinet, and make decisions, but the cabinet can review those decisions.
